Terms of Service

1. Acceptance of Terms
By accessing or using English Tracker (the "Service"), operated by Michael Araneda ("we," "us," or "the Data Controller"), an individual domiciled in Chile, you agree to these Terms of Service. If you do not agree, you must not use the Service.
2. Description of the Service
English Tracker is an English-learning platform that lets users track their progress against the Common European Framework of Reference for Languages (CEFR, levels A1 to C2) and generate AI-powered practice exercises (reading, writing, listening, and speaking). The Service offers a free plan with usage limits and paid plans for independent students and teachers.
3. User accounts
To use the Service you must create an account via email or Google authentication. You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information when registering. 3.1 Minimum age. The Service is intended for people 18 years of age or older. If you are a minor, you may only use the Service with the authorization and supervision of a parent or legal guardian, or through an account managed by a teacher/institution via the Service's teacher-student relationship feature. 3.2 Roles. There are three account types: independent student, teacher, and administrator. Teachers may invite and manage students; they are responsible for obtaining appropriate consent to link student accounts, especially when those students are minors.
4. Plans, pricing, and payments
4.1 The free plan includes limited access (currently up to 3 lifetime AI content generations, and access to tracker levels A1/A2). 4.2 Paid plans (Student Pro, Teacher Starter, Teacher Pro) are billed on a recurring basis (monthly or the period indicated at signup) through Mercado Pago, our payment processor. We do not store your card details; these are handled directly by Mercado Pago under its own policies. 4.3 You may cancel your subscription at any time from your account settings. Cancellation stops future renewal; you keep access to the paid plan through the end of the period already billed. 4.4 Refunds. Unless applicable law provides otherwise (for example, the right of withdrawal under Chile's Consumer Protection Law N° 19.496, where applicable to distance purchases), payments are non-refundable once a billing period has started. If you believe you were charged in error, contact us at contact@myenglishtracker.com. 4.5 We reserve the right to change plan pricing with reasonable prior notice published on the Service or sent by email; changes do not affect periods already paid for.
5. Acceptable use
When using the Service, you agree not to: (a) use the AI exercise generator for purposes other than language learning, or in a way intended to abusively exhaust system resources; (b) share your account with unauthorized third parties or sell access to it; (c) attempt to circumvent access controls, reverse-engineer the Service, or extract data from it without authorization; (d) upload or generate illegal, defamatory, discriminatory content, or content that infringes third-party rights.
6. AI-generated content
6.1 Exercises, feedback, and corrections produced by the Service are generated using third-party language models (Anthropic or DeepSeek, depending on current configuration) and may contain errors, inaccuracies, or non-idiomatic examples. The Service is a learning-support tool and does not replace instruction from a certified teacher, nor does it constitute an official language-level assessment. 6.2 Content you generate or obtain through the Service (exercises, answers, history) may be used by you for your personal learning. We do not guarantee the absolute originality of AI-generated content with respect to third parties. 6.3 When you share library content with a group or specific students (the "share" feature), you authorize those users to view it within the Service.
7. Intellectual property
The software, design, the "English Tracker" brand, and the underlying curriculum descriptors (adapted from the Council of Europe's Common European Framework of Reference) are owned by the Data Controller or used under corresponding license. No license is granted to reproduce, distribute, or create derivative works from the Service beyond the personal use permitted by these Terms.
8. Termination
We may suspend or terminate your account if you breach these Terms, including abusive use of the AI generator or fraudulent activity. You may delete your account at any time from settings; this does not entitle you to a refund for periods already paid for, except as stated in Section 4.4.
9. Limitation of liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted or error-free. We will not be liable for indirect damages, lost profits, or data loss arising from use of the Service, except in cases of willful misconduct or gross negligence.
10. Changes to these Terms
We may update these Terms periodically. Significant changes will be notified via a notice on the Service or by email at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of Chile, without prejudice to any rights consumer-protection law grants you in your country of residence.
